A Internet é um sistema de comunicação global que conecta pessoas –por meio computadores, laptops, tablets, telefones– para troca de informações, compartilhamento de dados pessoais e profissionais, de modo instantâneo e em qualquer lugar. O direito digital aborda várias questões jurídicas desde aspectos civis a criminais. A ubiquidade da internet apresenta questões desafiadoras ao direito nas formas de regulação. Desafia, igualmente, o direito internacional privado, para determinar os critérios dos elementos de conexão para a solução de litígios transnacionais, que, tradicionalmente, têm como base o espaço geograficamente definido. O presente curso objetiva estudar a Internet e o Direito Internacional Privado, de modo a contribuir para reflexões sobre os critérios para determinar a lei aplicável nas relações jurídicas internacionais, a jurisdição internacional, o reconhecimento e execução de sentenças estrangeiras, cooperação jurídica internacional e soluções de disputas online transnacionais. O curso estuda a governança global e a internet, as formas de regulação, analisa os casos jurídicos nacionais e estrangeiros e internacionais, a responsabilidade civil na Internet, os contratos comerciais e de consumo entre outros temas. |
