SUMMARY:

The scope of this work is to analyze the construction process, experience and coexistence of the protocols, based on the analysis of ILO Convention 169 and other regulations of national and international law. Based on the author's experience reports at the local level (within the community itself), and externally, we sought to highlight the degree of importance of this instrument in the defense of Quilombola communities. It was embodied in the work that the right to consultation, as a tool to guarantee the quilombos rights, can be used not only in the face of reactive cases of violation of rights as a result of the implementation of state enterprises. But also in cases of a preventive nature, as well as those focused on the impacts of public policies on Quilombola communities. It is perceived that academic and scientific research must also be submitted to the right to consultation.
