SUMMARY:

The purpose of this study is to demonstrate that the creation of the Health
Committees contributes to the improvement of systemic governance between the Judiciary
and the Executive in promoting the social right to health. After all, from the creation of these
Committees, which occurred as a result of an effort by the National Council of Justice – CNJ,
a positive dialogical interaction was established between Executive and Judiciary, as those
Committees are composed of professionals from the health area and the area of public
policies. Thus, in the face of a collaborative and systematic process in which governance
appears as a fundamental tool to combat organizational management failures and the
deleterious impacts of judicialization in health, the State's efficiency in providing positive services and realizing this fundamental right is promoted. Given this, considering that each state Court and each federal Court has its Health Committee, the proposal of a collaborative governance model becomes relevant so that the development of solutions in this dialogicalcollaborative environment is equally used in all Health Committees.
