SUMMARY:

This thesis is about telling the story of a great process of institutional construction that I dare to identify as “the conquest of the Casa-Grande”. That is, it is about narrating episodes judged central to the political struggle to construct the National Council of Justice – the administrative and disciplinary control body of the Brazilian judiciary – since the process of its constitutional creation, an opportunity to manifest a series of institutional movements of conquest, tangled in the desires for the democratization of the internal relations of the Brazilian judiciary and by the restructuring and reorganization of the public service of justice provision. From a pragmatist inclination, this investigation traces how a network of action of actors linked to the judicial field has been weaving what I propose to identify from an “ecology of conquest” – a political-creative complex of rules and resources (ideas, fields, symbols, processes, actors, and relationships) to dilute the administrative power of Brazilian courts to pursue the implementation of policies to restructure judicial provision. The research was constructed from empirical intertwining between observations participating in the process of construction of the National Goals of the Judiciary, on-site visits to Courts of Justice, in-depth interviews, and an intense mobilization of statements by key actors in the initial construction of the CNJ and journalistic and institutional documents. The descriptive-analytical part, organized into “episodes”, tries to show how, under institutional movements, the CNJ manifests itself in its different institutional natures - meta-idea, organization, and policies – and how these manifestations, which constitute each other, can be perceived from the ontological assumption that institutions are resources for political creativity more than mere constraint. In addition, the axis still presents the historical reconstruction of the institutional construction of the body “that brought the Judiciary to democracy” and that diluted some structural barriers between courts and society.
