SUMMARY:

The aim of this doctoral project is to analyze the phenomenon of corruption from a political point of view, based on legal discourses produced in Portugal in the 15th century. The proposal is particularly interested in presenting and explaining how these discourses, which cover the field of law and justice, configure a certain way of conceiving the political model by which that society was organized, as well as recording the various ways in which this configuration was experienced, transformed into politics. In this sense, the aim is to analyze the extent to which both the model and its realization in history are evaluated by the agents who appear in the selected documentation, sometimes as virtue, sometimes as corruption, mainly through moral evaluations, but which, from the perspective of history, translate political scenarios that need to be interpreted. With regard to the dynamism of these contexts, some aspects stand out, such as the elasticity observed in the act of interpreting and giving meaning to norms, a characteristic that allowed accusations of corruption to be handled according to situational political interests. Similarly, acts usually classified as corruption could be tolerated, depending on the agents and the peculiarities surrounding the case. In the political architecture of Iberian society, marked by the relative autonomy of political bodies, competition and conflict, the accusation that historical agents had committed acts classified as corrupt was an important mechanism for removing opponents from the political arena and legitimizing the victors. Despite the remarkable variability of what could be considered corruption, historiography still shows a marked tendency to analyze the phenomenon from a moral point of view - the same adopted by the primary sources - and/or through anachronistic legal perspectives through which contemporary notions are transplanted to the object of study, for example, the principles that guide the separation between public and private. The documentary corpus, initially selected, includes the Ordinances of King Duarte, the Book of Laws and Ordinances, the Ordinances of the Republic of Portugal and the Ordinances of the Kingdom of Portugal.
