SUMMARY:

This paper analyzes Law No. 13,123 of 2015, the concepts of the forms of protection for traditional knowledge and the conditions for indigenous peoples, traditional communities and traditional farmers to receive benefit sharing for access to their knowledge associated with genetic heritage. Only in cases where this knowledge has an identifiable origin and when it results in the economic exploitation of a finished product, will a given indigenous population or traditional community that created, developed, holds, or conserves the exploited traditional knowledge be entitled to monetary or non-monetary benefit sharing. According to the legal framework, cultural inventories, records in registries or databases, and scientific publications are the main forms of recognition of traditional knowledge associated with genetic heritage. Given the limitations of public policies to identify and generate information systems on the immense body of knowledge, know-how, creations, innovations, and practices of traditional peoples and communities associated with biodiversity, the legal protection against illegal exploitation and the proper sharing of benefits provided for in the legislation do not occur satisfactorily. The objective of this study was to evaluate how the main existing programs and instruments for registering intangible cultural assets in the country can contribute to the inventory and safeguarding of traditional knowledge associated with biodiversity, which, according to Law 13,123, is part of Brazil's cultural heritage. The methodology used to conduct the research was inductive, conducted through bibliographic and documentary research and the qualitative method. The study showed that the lines of action of the National Intangible Heritage Program, managed by the Institute for National Artistic and Historical Heritage (IPHAN), especially the macro-process of Identification of Intangible Cultural Property, is an important instrument for indigenous populations, traditional communities and traditional farmers to strengthen their autonomy in the protection, use and transmission of their traditional knowledge, aiming at the sustainability of their ways of life and their territories, and, effectively, receive the due benefits when third parties appropriate their knowledge.
