SUMMARY:

This work analyzes the process of dismantling the Moderating Power in the Constituent Assembly of 1890/1891, with a view to protecting human rights. It studies the potential historical construction of authoritarianism, focusing on the constituent debates of 1890/1891 and the Moderating Power. Therefore, it analyzes the possible survival of the Moderating Power in the 1891 constitutional text.
