SUMMARY:

ADPF 475, judged in April 2023, declared that article 166 of the Military Penal Code had been accepted. However, the decision did not delve into the historical-constitutional issue, since the Military Penal Code has an origin of dubious constitutionality. It was not promulgated by the National Congress, but granted by a Military Junta in 1969. Likewise, the ADPF has not demonstrated whether there is a link between the Theory of Special Relations of Subjection and the restriction of fundamental rights, nor how this connection applies to the freedom of expression of military police officers. Nor did it clarify the limits of the academic freedom of state military personnel. This study aims to clarify these gaps from the perspective of fundamental rights.
