SUMMARY:
The research presented here brings philosophical-theoretical concerns to the state of the art of Constitutionalism studies. Seeking its foundation in the conceptions of the Critical Theory of Law, in this quadrant, of Law Found on the Street, and the epistemologies of Good-Living and Decoloniality, it is proposed in the monographic excerpt in question, to problematize the discourse of the domains of liberalism seeking, in to a certain extent the overcoming of the mechanisms that, in this way of realizing society, throughout its conceptual and political deviation, began to subsidize the oppression and subalternization of subjects, especially the vulnerable. Contrary to what is called common belief, liberal thought (and action) is increasingly contrary to the human event of constancy, that is, the survival of the planet, its maintenance of effective conditions of life and quality of life for all beings, moreover, for the full realization of civilizations, as a cultural, sociological and historical dynamic with a view to the Freedom of persons, particularly those dispossessed. In other words: for humanity to reconnect with other factors fundamental to life and societies, the arrangement founded by what we know in the hegemony of concepts such as the generations of fundamental rights is not sufficient; This is the scope of an – already – insufficient Constitutionalism. Therefore, the new civilizational aesthetics requires the ignition of a deep dialectic regarding the effective reasons for Democracy, Citizenship and Human Rights. In this way, the path of this study is being funneled to, from Latin America, focus on Brazil, however, reflecting potential problems – almost universal. That said, by studying, especially Roberto Lyra Filho, Ailton Krenak, Raquel Yrigoyen Fajardo and José Geraldo de Sousa Junior, we provide society with an additional compendium for what is known as Constitutionalism Found on the Street.
