TITLE:

Child marriage as a form of enslavement in Brasil.

KEY WORDS:

Child marriage; form of enslavement; factors of invisibility and acceptance; Brazil.

PAGES: 35
BIG AREA: Ciências Sociais Aplicadas
AREA: Direito
SUMMARY:

The United Nations has reaffirmed that forced marriages are a form of slavery present throughout the world, and that all child marriages are forced, since a child (a person under the age of 18) is not capable of validly consenting (Oit , Oim & Walk Free, 2022). In Brazil, however, although the country is a global reference in combating contemporary forms of slavery, there is no evidence of the recognition of child marriages as a form of slavery. The research project, of an exploratory quantitative and qualitative nature, problematizes the invisibility of child marriages as a form of slavery in Brazil, and aims to understand the political, legal, economic, social and cultural factors that contribute to invisibility and acceptance of the phenomenon. The theoretical paradigms of the research are the critical theory of human rights by Herrera Flores and the decolonial feminism by Maria Lugones. The methodology used is bibliographic and documentary review, as well as empirical research into legal proceedings. The results already achieved are presented.
