Esta dissertação apresenta uma análise das políticas públicas implementadas no contexto da Operação Acolhida, que emergiu como resposta ao fluxo de pessoas indígenas Warao no norte do Brasil. O estudo investiga os desafios enfrentados pelos governos local e federal diante das especificidades das comunidades indígenas Warao, que buscavam proteção internacional e uma vida digna em Roraima. Embora a Operação Acolhida tenha sido concebida como uma medida emergencial, sua continuidade após cinco anos revela a persistência do discurso de "emergência contínua". Esta pesquisa propõe uma reflexão sobre o modelo emergencial adotado na resposta aos refugiados Warao no Brasil, bem como suas consequências para as comunidades indígenas refugiadas. Além disso, busca-se analisar os efeitos da perpetuação do atendimento emergencial na efetivação dos direitos humanos e na autonomia dos indígenas Warao em busca de refúgio, considerando a atuação do Estado nesse contexto. O estudo contribui para o entendimento das dinâmicas sociais e políticas envolvidas no acolhimento de refugiados indígenas, destacando a necessidades da mudança de lógica na atenção destas populações para garantir uma proteção efetiva e a realização plena dos direitos humanos dessas comunidades.

This thesis presents an analysis of public policies implemented in the framework of Operation Acolhida, which emerged as a response to the influx of indigenous Warao people in northern Brazil. The study examines the challenges faced by local and federal governments considering the specificities of the Warao indigenous communities, who sought international protection and a dignified life in Roraima. Despite Operação Acolhida being initially conceived as an emergency measure, its continuation after five years reveals the persistence of the discourse surrounding "continuous emergency." This research proposes a reflection on the emergency model adopted in response to Warao refugees in Brazil, as well as its consequences for the indigenous refugee communities. Furthermore, it seeks to analyze the effects of perpetuating emergency assistance on the realization of human rights and the autonomy of the Warao indigenous people in their search for refuge, considering the role of the State in this context. The study contributes to understanding the social and political dynamics involved in the reception of indigenous refugees, highlighting the need for a paradigm shift in addressing the needs of these populations to ensure effective protection and the full realization of their human rights.

O Direito é estruturado pelo racismo e é imprescindível para a reprodução da violência racial. Apesar disso, pouco se sabe a respeito do lugar do ensino jurídico nessa relação dialética e complexa. Assim, este trabalho objetiva compreender de que modo o racismo se manifesta no ensino jurídico. Em razão do caráter exploratório do tema, a metodologia foi pensada a partir da Teoria Fundamentada dos Dados Construtivista, que orientou tanto a escolha das fontes de informação, quanto as análises. As fontes utilizadas foram: narrativas de duas professoras negras de cursos de Direito, a partir de entrevistas semiestruturadas; o Relatório Final da Comissão para Estudo e Adequação do Projeto Político-Pedagógico do Curso de Direito da UEFS ao Debate Racial; e o TCC “A atuação do Coletivo de Assessoria Jurídica Universitária Popular Luiz Gama/UNEB (Juazeiro/BA) à luz do artigo 207 da Constituição Federal de 1988”, associado a reflexões pessoais sobre meu processo formativo. Todas as instituições que sediam a pesquisa estão localizadas no Nordeste brasileiro. Além disso, realizei revisão de literatura sobre o tema, com buscas em bancos de teses e dissertações e nas plataformas Scielo e Portal de Periódicos CAPES. Alguns dos conceitos sensibilizantes são a “educação como prática de liberdade” de Paulo Freire e bell hooks, o “racismo estrutural” de Silvio Almeida e o “Direito como organização social legítima da liberdade” de Roberto Lyra Filho. Os resultados indicam quatro categorias analíticas para pensar o racismo no ensino jurídico: “construindo a identidade racial”, “sentindo o racismo”, “construindo a visão de mundo” e “interpelando o epistemicídio jurídico”. De modo geral, elas articulam elementos subjetivos – relacionados à cognição, ao afeto e aos comportamentos de professores(as) e alunos(as) – e objetivos – relativos à estrutura institucional dos cursos. Desse modo, o racismo no ensino jurídico despontou como problema multifacetado, mas que precisa ser enfrentado pelas instituições de maneira urgente e comprometida.

Law is structured by racism and is indispensable for the reproduction of racial violence. Despite this, little is known about the place of legal education in this dialectical and complex relationship. Thus, this work aims to understand how racism manifests itself in legal education. Due to the exploratory nature of the theme, the methodology was based on the Constructivist Grounded Theory, which guided both the choice of sources of information and the analyses. The sources used were: narratives of two black professors from law courses, based on semi-structured interviews; the Final Report of the Commission for the Study and Adequacy of the Political-Pedagogical Project of the Law Course of UEFS to the Racial Debate; and the Final Paper "The performance of the Coletivo de Assessoria Jurídica Popular Luiz Gama/UNEB (Juazeiro/BA) in the light of article 207 of the Federal Constitution of 1988", associated with personal reflections about my formative process. All the institutions hosting the research are located in the Brazilian Northeast. In addition, I conducted a literature review on the theme, with searches in thesis and dissertation banks and in the platforms Scielo and Portal de Periódicos CAPES. Some of the sensitizing concepts are "education as freedom practice" by Paulo Freire and bell hooks, "structural racism" by Silvio Almeida, and "Law as legitimate social organization of freedom" by Roberto Lyra Filho. The results indicate four analytical categories for thinking about racism in legal education: "constructing racial identity", "feeling racism", "constructing worldview", and "interpellating legal epistemicide". In general, they articulate subjective elements – related to the cognition, affect and behavior of professors and students – and objective elements – related to the institutional structure of the courses. Thus, racism in legal education has emerged as a multifaceted problem, but one that needs to be faced by institutions in an urgent and committed manner.

Diante do novo quadro político emergido em 2019 no Brasil, com a supremacia de princípios neoliberais e conservadores, em especial na valorização da cultura castrense nas diversas esferas sociais, uma política cunhada no compartilhamento da gestão escolar com Instituições de Segurança ganhou notoriedade no panorama da Educação em e para os Direitos Humanos, levantando indagações acerca da formação humana dos educandos e da autonomia das unidades escolares diante da intervenção dos militares. Por meio da abordagem do Ciclo de Políticas, teoria desenvolvida por Stephen John Ball e outros autores, a pesquisa analisou o projeto de gestão compartilhada nas escolas-piloto da rede pública do Distrito Federal, a partir da ótica dos policiais militares envolvidos e, com base ainda nas reflexões críticas de Michel Foucault e Paulo Freire, pôde realizar uma meditação acerca das influências, dos artefatos e dos interesses intrínsecos na política. As entrevistas desenvolvidas com os policiais militares, somadas aos diálogos impulsionados a partir da leitura dos textos e dos discursos em cada contexto, confirmaram a capacidade interventora que o militar tem na “implementação” da política, ressignificando e flexionando os conceitos e regulamentos, sustentando assim seu caráter protagonista no contexto da prática e resguardando no cotidiano escolar, onde as políticas são interpretadas e rearranjadas, através do poder disciplinar, o domínio do Estado na gestão dos interesses políticos

Faced with the new political framework that emerged in 2019 in Brazil, with the supremacy of neoliberal and conservative principles, especially in the appreciation of military culture in the various social spheres, a policy coined in the sharing of school management with Security Institutions gained notoriety in the Education panorama in and for Human Rights, raising questions about the human formation of students and the autonomy of school units in the face of military intervention. Through the Policy Cycle Approach, a theory developed by Stephen John Ball and other authors, the research analyzed the shared management project in the pilot schools of the public education network of the Federal District, from the perspective of the military police officers involved and, based on still in the critical reflections of Michel Foucault and Paulo Freire, he was able to carry out a meditation on influences, artifacts and intrinsic interests in politics. The interviews carried out with the military police officers, added to the dialogues driven from the reading of the texts and speeches in each context, confirmed the intervening capacity that the military has in the “implementation” of the policy, reframing and flexing the concepts and regulations, thus sustaining its protagonist character in the context of practice and safeguarding in the school routine, where policies are interpreted and rearranged, through disciplinary power, the State's domain in the management of political interests.

A presente pesquisa se estrutura em três capítulos, trazendo um quadro da mortalidade materna no Brasil dos anos 80 até o ano pandêmico de 2021, principais causas de morte materna e do modelo de atenção obstétrica do SUS, fazendo uma análise da dificuldade com os dados, especialmente aqueles desagregados por raça/cor. Aborda a violência obstétrica enquanto categoria analítica estratégica para que as mulheres possam enunciar suas dores, detalhando as formas conhecidas de violência nos serviços obstétricos e a resistência dos profissionais de saúde em reconhecer o termo, negando as práticas violadoras reiteradas. Traz uma análise do dispositivo de racialidade no atendimento obstétrico (da gestação ao puerpério e situações de abortamento) que marcam ou matam mulheres negras cotidianamente numa lógica da instrumentalização, controle e do extermínio dos corpos negros e precarização programada pelo mercado, onde a identidade/filiação étnico-racial determina o modelo do atendimento, demonstrando que a violência obstétrica revela a perversidade engenhosa do estado na gestão da dor e da morte de um determinado grupo populacional, permitindo confirmar a hipótese que deu título ao presente trabalho, CAUSA MORTIS: RACISMO, e demonstrando a importância da transversalidade de raça/etnia na saúde como estratégia de prevenção de violência obstétrica que impactará nos índices de mortalidade materna, ressaltando a necessidade de interseccionar as políticas de saúde com as políticas de equidade de raça e etnia, com o enfrentamento ao racismo como pressuposto da formação e atuação em saúde.

The present research is structured in three chapters, bringing an overview of maternal mortality in Brazil from the 80s until the pandemic year of 2021, main causes of maternal death and the model of obstetric care of SUS, making an analysis of the difficulty with the data, especially those disaggregated by race/color. Addresses obstetric violence as a strategic analytical category for women to enunciate their pain, detailing the known forms of violence in obstetric services and the resistance of health professionals to recognize the term, denying the repeated violating practices. It brings an analysis of the raciality device in obstetric care (from pregnancy to the puerperium and abortion situations) that marks or kills black women daily in a logic of instrumentalization, control and the extermination of black bodies and programmed precarization by the market, where the ethno-racial identity/affiliation determines the model of care, demonstrating that obstetric violence reveals the ingenious perversity of the state in managing pain and death of a certain population group, allowing confirmation of the hypothesis that gave title to this work, CAUSA MORTIS: RACISM, and demonstrating the importance of race/ethnicity transversality in health as a strategy to prevent obstetric violence that will impact maternal mortality rates, highlighting the need to intersect health policies with race and ethnicity equity policies, with the confrontation of racism as a presupposition of training and performance in health.

Esta dissertação é resultado de pesquisa realizada sobre as práticas e saberes das Coordenadoras do Movimento dos Trabalhadores Sem-Teto (MTST) para a promoção do direito humano à alimentação e nutrição adequadas (DHANA). Como lócus de pesquisa, foram eleitas as Cozinhas Solidárias do MTST-DF, tecnologias sociais de distribuição de almoços gratuitos e de realização de atividades de cuidado comunitárias. Para tanto, foram investigadas as percepções das mulheres sem-teto sobre as influências de gênero, raça e classe na vivência da fome e sua permeabilidade nas políticas públicas de promoção de segurança alimentar e nutricional. Neste trabalho, o MTST emerge como sujeito coletivo de direitos (SOUSA JUNIOR, 2011) e é representado pela maioria social que se organiza no movimento: mulheres negras, mães, avós, trabalhadoras do cuidado, trabalhadoras desempregadas ou informais. A partir da negação dos pressupostos materiais e imateriais para a fruição de vida digna pelas mulheres negras periféricas, sua organização e a luta social para conquistá-los são dotadas de capacidade instituinte de direitos. Uma vez que há prevalência da fome em famílias chefiadas por mulheres negras e estas também se consolidam como linha de frente da referida iniciativa comunitária para combatê-la, propõe-se observar a agência afrodiaspórica dessas sujeitas na construção dos direitos humanos, a partir da categoria de amefricanidade de Lélia Gonzalez (1988) e da proposta epistemológica de traduzir direitos humanos em pretuguês de Thula Pires (2017). O ponto de chegada da referida dissertação é a proposta de tradução do direito humano à alimentação e nutrição adequada em pretuguês a partir do protagonismo social das Coordenadoras do MTST no Distrito Federal.

This dissertation is the result of research carried out on the practices and knowledge of the Coordinators of the Homeless Workers Movement (MTST) to promote the human right to adequate food and nutrition (DHANA). As a research locus, the MTST-DF Solidarity Kitchens were chosen, which are social technologies for distributing free lunches and carrying out community care activities. To this end, homeless women's perceptions of the influences of gender, race and class on the experience of hunger and their permeability in public policies to promote food and nutritional security were investigated. In this work, the MTST emerges as a collective subject of rights (SOUSA JUNIOR, 2011) and is represented by the social majority that is organized in the movement: black women, mothers, grandmothers, care workers, unemployed or informal workers. From the denial of material and immaterial assumptions for the enjoyment of a dignified life by peripheral black women, their organization and the social struggle to conquer them are endowed with the capacity to establish rights. Since there is a prevalence of hunger in families headed by black women and they are also consolidated as the front line of the aforementioned community initiative to combat it, it is proposed to observe the Afro-diasporic agency of these subjects in the construction of human rights, from the category of amefricanity by Lélia Gonzalez (1988) and the epistemological proposal of translating human rights into Portuguese by Thula Pires (2017). The point of arrival of this dissertation is the proposal to translate the human right to food and adequate nutrition into Portuguese based on the social protagonism of the MTST Coordinators in the Federal District.

A evasão escolar é um grande problema na educação a distância. O número de alunos que desistem durante o curso é grande e isso está relacionado, também, com a falta de interação, de engajamento e motivação para chegar até o final do curso. Essa pesquisa se propôs a estudar a questão a evasão escolar na educação superior, a fim de compreender o contexto de crescimento e mercantilização da educação em que o problema está inserido, analisando os interesses mercadológicos perseguidos pelas instituições de ensino, em contrapartida com a função tradicional da educação superior e o propósito da aprendizagem. A partir disso, analisamos a proposta de empresas desenvolvedoras de chatbots para a educação superior, por meio da análise de conteúdo de artigos publicados em blogs de quatro empresas desenvolvedoras de chat bots. Descobrimos que a proposta destas empresas é de que o uso dos chatbots integra principalmente o desenvolvimento de atividades administrativas das instituições, mas também de atividades pedagógicas. O principal incremento proposto é a melhora na comunicação com os alunos. As empresas desenvolvedoras acreditam que os chatbots podem contribuir, sobretudo, para melhorar a produtividades das instituições. Quanto as atividades pedagógicas, o uso dos chatbots é empregado majoritariamente para realização de tarefas prescritas, seguindo uma lógica instrucionista.

School dropout is a major problem in distance education. The number of students who give up during the course is high, and this is also related to the lack of interaction, engagement, and motivation to complete the course. This research aimed to study the issue of school dropout in higher education in order to understand the context of growth and commercialization of education. The market interests pursued by educational institutions were analyzed in contrast to the traditional function of higher education and the purpose of learning.. Based on this, we analyzed the proposal of companies developing chatbots for higher education by conducting a content analysis of articles published on the blogs of four chatbot development companies. We found that the proposal of these companies is that the use of chatbots mainly integrates the development of administrative activities of institutions but also pedagogical activities. The main improvement proposed is the enhancement of communication with students. The developing companies believe that chatbots can contribute primarily to improving the productivity of institutions. As for pedagogical activities, the use of chatbots is predominantly employed for the completion of prescribed tasks, following an instructionism logic

Essa dissertação aborda a participação das mulheres afro na Argentina, considerando a invisibilidade da população afrodescendente e a visibilidade dos feminismos no país. A partir da pergunta "como as mulheres afro têm se encontrado e construído sua articulação na Argentina?", a pesquisa tem por objetivo compreender como as mulheres afro construíram seus espaços políticos e coletivos próprios a partir de 2016, com o taller sobre mulheres afro no Encontro Nacional de Mulheres, em Rosário. Construída principalmente a partir de uma pesquisa de campo, com entrevistas e observação participante, realizada em julho de 2021, além de uma revisão bibliográfica e documental, essa dissertação elabora uma perspectiva feminista afrolatinoamericana sobre as lutas por participação das mulheres afro na Argentina, abordando suas estratégias e principais áreas de atuação. A fim de demonstrar essas lutas como uma forma de realização prática de uma perspectiva crítica de direitos humanos, as mulheres afro – marginalizadas e apagadas da sociedade argentina - são colocadas no centro como as sujeitas principais de um enfrentamento ao sistema moderno/colonial de gênero. Através de seus corpos, mobilizam outras territorialidades e perspectivas, que diretamente buscam lutar por seus direitos humanos ao propor transformações na sociedade argentina e nos projetos de poder. As mulheres afro constroem novos movimentos sociais, que buscam reconhecimento e justiça social, e mobilizam seus corpos-territórios nas ruas por seu direito de aparecer, e participar ativamente para construir outras formas de reconhecimento, memória coletiva, representação e participação da população afrodescendente.

This dissertation investigates the participation of Afro women in Argentina, considering the invisibility of the Afro-descendant population and the visibility of feminisms in the country. Based on the question "how have women of African descent met and built their articulation in Argentina?", the research aims to understand how Afro women have built their own political and collective spaces since 2016, with the taller on women of African Descent at the National Women's Encounter in Rosario. Constructed mainly from a field trip, with interviews and participant observation, carried out in July 2021, as well as a bibliographical and documentary review, this dissertation develops on an AfroLatinAmerican feminist perspective on the struggles for participation of women of African descent in Argentina, addressing their strategies and main areas of action. To demonstrate such struggles as a form of practical realisation of a critical human rights perspective, Afro women - marginalised and erased from Argentinian society - are placed at the centre and as the main subjects of a confrontation with the modern/colonial gender system. Through their bodies, they mobilise other territorialities and perspectives, which directly seek to fight for their human rights by proposing transformations in Argentinian society and power projects. Women of African descent are building new social movements, seeking recognition and social justice, and mobilising their bodies-territories in the streets for their right to appear and actively participate in building other forms of recognition, collective memory, representation and participation for the population of African descent

A pesquisa busca explorar o fenômeno sócio-histórico da situação de rua, que remete, sobretudo nos grandes centros urbanos, a uma realidade relegada à marginalidade da vida cotidiana, tornando por evidenciar profundas assimetrias sociais e econômicas que suprimem direitos, identidades e os discursos de toda uma população. Desse modo, a partir das experiências construídas no campo, dialogando com as história de vida de quatro pessoas que vivem em situação de rua, no Rio de Janeiro, no Bairro do Flamengo, buscou-se compreender o que é a rua para quem vive nela, as implicações do viver nesses espaços controlados, além das visões de pessoas que compõe essa população, sobre aspectos fundantes da vida delas.

The research seeks to explore the socio-historical phenomenon of homelessness, which refers, mainly in large urban centers, to a reality relegated to the marginality of everyday life, evidencing deep social and economic asymmetries that suppress rights, identities and the discourses of an entire population. Thus, from the experiences built in the field, dialoguing with the life stories of four people who live on the street, in Rio de Janeiro, in the Flamengo neighborhood, we seek to understand what the street is for those who live in it, the implications of living in these controlled spaces, in addition to the vision of the people who make up this population, on fundamental aspects of their lives.

Essa dissertação buscou analisar se o Ministério Público do Distrito Federal e Territórios (MPDFT) seguiu as recomendações da Lei 12.990/2014, assim como realizou a implementação da Lei de Cotas para negras e negros em seus concursos públicos, de forma a aumentar a presença de negras e negros em seus quadros, com destaque ao último concurso do MPDFT para o cargo de Promotor Adjunto (Concurso nº 32). O objetivo dessa dissertação foi analisar a implementação da lei de Cotas no Serviço Público Federal, com destaque ao caso do MPDFT, em seu concurso nº 32 para ingresso de promotores adjuntos, de forma a identificar como ocorreu tal processo nesta instituição e se ocorreu conforme os ditames legais. Desde sua vigência em 10 de junho de 2014, quando foi publicada, a Lei 12.990/2014 vem sendo aplicada nos concursos públicos federais. Atualmente, o Ministério Público Federal tem adotado tais premissas na seleção de futuros membros e servidores, reservando 20% de suas vagas para cotas raciais. Tal política pública representa avanço na luta contra o racismo, especialmente quando se trata de cargos de alto comando e chefia, como os de Promotores Federais. Dados do Ipea destacam que o Brasil tem aproximadamente 9.963 membros do Ministério Público, em sua grande maioria composta por promotores brancos. O estudo conta com uma breve análise histórica das ações afirmativas no Brasil e uma análise documental do processo do concurso nº 32 do MPDFT, bem como a realização de entrevistas semiestruturadas. Tais entrevistas ajudaram a entender os processos e as dificuldades para a implementação da Lei 12.990/2014 dentro do concurso para selecionar novos promotores adjuntos para a instituição. Ao longo da análise dos processos adotados no MPDFT para implementação da lei de cotas em seu concurso para Promotor Adjunto, pode-se concluir que a Lei 12.990/2014 foi implementada no concurso nº 32 do MPDFT. Todavia, ainda se faz imperioso a adoção de políticas públicas e procedimentos que possam aumentar a quantidade de aprovação de negras e negros nos certames, em especial nos cargos do alto funcionalismo federal.

This dissertation sought to analyze whether the Public Ministry of the Federal District and Territories (MPDFT) followed the recommendations of the Law 12,990/2014, as well as implementing the Quota Law for black men and women in its public competitions, in order to increase the presence of black men and women in its selection, with emphasis on the latest MPDFT competition for the position of Deputy Prosecutor (Competition no. 32). The central objective of this dissertation was to highlight the stepby-step process of implementation in the MPDFT, in order to highlight the quota law as an important instrument in combating racism present in all social, political and economic structures in Brazil. Since its entry into force on June 10, 2014, when it was published, Law 12,990/2014 has been applied to federal public tenders. Currently, the Federal Public Ministry has adopted such proposals in the selection of future members and civil servants, reserving 20% of its vacancies for racial quotas. Such public policy represents progress in the fight against racism, especially when it comes to high command and leadership positions, such as Federal Prosecutors. Data from Ipea highlights that Brazil has approximately 9,963 members of the Public Ministry, the vast majority of whom are white prosecutors. The methodology applied was a brief historical analysis of the process of racism and affirmative actions in Brazil and a documentary analysis of the MPDFT competition no. 32 process, as well as semi-structured interviews. These interviews seek to understand the processes and difficulties in implementing Law 12,990/2014 in order to select new deputy prosecutors for the institution. In this sense, throughout the analysis of the processes adopted by the MPDFT to implement the quota law in its contest for Deputy Prosecutor, it can be concluded that Law 12,990/2014 was innovative and present in contest no. 32 of the MPDFT. However, it is still imperative to adopt public policies and procedures that can increase the number of approvals by black men and women in certain positions, especially in senior federal civil service positions.

O presente trabalho se propõe em colocar no centro das discussões dos direitos humanos uma discussão ensolarada sobre as raízes étnico-raciais do armário, buscando ainda compreender as suas representações sociais no imaginário de profissionais que trabalham em políticas públicas. Trata-se da analítica da colonialidade de sexualidade e gênero no pensamento profissional sobre Assistência à saúde LGBTQIA+ . O estudo também procurou investigar se a raça, a orientação sexual e a identidade de gênero dos profissionais influenciam na qualidade do serviço. A fonte de dados foi estabelecida a partir de um curso ofertado para profissionais da área da saúde. Como um dos resultados principais, verificou-se que o armário filiado ao paradigma da colonialidade, promove o controle de qualidade dos serviços prestados pelos profissionais do SUS, que possui na sua base de atendimento populações que historicamente são subjugadas pelo racismo.

This work proposes to place at the center of human rights discussions a sunny discussion about the ethnic-racial roots of the closet, seeking to understand its social representations in the imagination of professionals who work in public policies. This is the analysis of the coloniality of sexuality and gender in professional thinking about LGBTQIA+ health care. The study also sought to investigate whether the race, sexual orientation and gender identity of professionals influence the quality of the service. The data source was established from a course offered to health professionals. As one of the main results, it was found that the cabinet affiliated with the paradigm of coloniality, promotes quality control of services provided by SUS professionals, which has in its service base populations that have historically been subjugated by racism.

O presente trabalho parte da fortuna crítica amealhada pela escola jurídica do Direito Achado na Rua, sobretudo das noções de sujeito coletivo, extralegalidade e de Rua, concebida como metáfora referente ao espaço público no qual se promove a invenção de direitos no contexto de uma legítima organização social da liberdade. Assim como o Direito Achado na Rua compreende viável a constituição (invenção) de direitos sem a necessidade de intermediação de textos normativos emanados do poder estatal, o trabalho foca na extralegalidade como um potencial campo de desconstituição de direitos, lançando mão das noções de "destruição por dentro" ou "cupinização" como fatores de erosão institucional. Tais aspectos decorrem centralmente de práticas desconstituintes, sem que o ataque a direitos fundamentais passe, necessariamente, por alterações normativas próprias da arena parlamentar, com a consequente redução dos espaços de transparência e deliberação. A hipótese da pesquisa é de que a reconstituição de direitos atacados na Amazônia brasileira pode ser promovida pela mobilização social, especialmente dos sujeitos coletivos afetados. Nesse contexto, emprega-se a categoria povos-floresta, cunhada por Eliane Brum, que traduz a relação indissociável entre povos tradicionais e a natureza, em oposição ao povo da mercadoria, a que alude Davi Kopenawa. O recorte da pesquisa volta-se à Amazônia brasileira, palco histórico, mas também recente, de práticas violadoras de direitos fundamentais e de sistemático silenciamento e racismo ambiental. Ainda mais especificamente, o trabalho realça o caso da Usina Hidrelétrica de Belo Monte, emblemático episódio apto a retratar que visões autoritárias no contexto da Amazônia brasileira constituem aspectos que remontam à época colonial, percorrem a era da ditadura empresarial-militar e alcançam até mesmo governos progressistas e democráticos, a revelar a indispensabilidade de que a própria sociedade tenha meios de enfrentamento dessas práticas desconstituintes. A UHE Belo Monte motivou a instituição do Plano de Desenvolvimento Regional Sustentável do Xingu (PDRS-X), com a implantação de um colegiado composto paritariamente entre membros estatais e não estatais com atribuição para apreciação de projetos e destinação de 500 milhões de reais. A pesquisa analisa o arranjo institucional do colegiado e seu funcionamento, correlacionando as iniciativas (estatais, sociedade civil em geral e povos-floresta) e a destinação (interesse público primário geral, interesse público secundário e povos-floresta). Verificou-se que a atuação dos povos-floresta no órgão traduz a presença da própria natureza como sujeito coletivo no colegiado, o que se infere a partir das destinações dos projetos e da relação indissociável entre povos tradicionais e a natureza. Já os membros estatais desempenharam papel voltado ao próprio custeio da burocracia (interesse público secundário) ou, no muito, ao interesse público primário geral, utilizando-se do PDRS-X como simples fonte potencializadora de recursos sem vinculação necessária com a defesa dos povos-floresta. Dessa forma, o PDRS-X configuraria relevante episódio de experimentalismo institucional que poderia legitimar que os povos-floresta ocupem diretamente espaços de poder como forma de enfrentamento de práticas desconstituintes de direitos na Amazônia brasileira. Essa prática reconstituinte anterior corrobora que os povos-floresta sejam protagonistas na definição da vazão do rio Xingu no Trecho de Vazão Reduzida, de modo que a partilha das águas deve ser realizada com base em critérios ecossistêmicos que valorizem os conhecimentos tradicionais.

The present work builds upon the critical wealth amassed by the legal school of Law Found in the Street, particularly from the notions of collective subject, extralegality, and the Street conceived as a metaphor for the public space where the invention of rights occurs within the context of a legitimate social organization of freedom. Just as Law Found in the Street deems feasible the constitution (invention) of rights without the need for intermediation by normative texts emanating from state power, this work focuses on extralegality as a potential field for the deconstruction of rights, employing the concepts of 'internal destruction' or 'termite-like erosion' as factors of institutional erosion. These aspects primarily stem from deconstructive practices, where the assault on fundamental rights does not necessarily entail normative alterations within the parliamentary arena, leading to a subsequent reduction in spaces for transparency and deliberation. The research hypothesis suggests that the reconstruction of violated rights in the Brazilian Amazon can be promoted through social mobilization, especially by affected collective subjects. Within this context, the term 'forest-peoples,' coined by Eliane Brum, is employed, encapsulating the inseparable relationship between traditional peoples and nature, in opposition to the 'commodity people' referred to by Davi Kopenawa. The research scope is directed towards the Brazilian Amazon, a historical stage but also a recent one marked by violations of fundamental rights and systematic silencing and environmental racism. More specifically, the work highlights the case of the Belo Monte Hydroelectric Plant, an emblematic episode capable of illustrating how authoritarian views in the context of the Brazilian Amazon trace back to the colonial era, extend through the era of the corporate-military dictatorship, and even persist within progressive and democratic governments, underscoring the indispensability of society itself having means to confront these deconstructive practices. The Belo Monte Hydroelectric Plant motivated the establishment of the Xingu Sustainable Regional Development Plan (PDRS-X), forming a collegiate body composed equally of state and non-state members tasked with evaluating projects and allocating 500 million reais. The research analyzes the institutional arrangement of this collegiate body and its functioning, correlating the initiatives (state, civil society at large, and forest-peoples) and allocation (primary general public interest, secondary public interest, and forest-peoples). It was observed that the involvement of the forest-peoples in the body reflects the presence of nature itself as a collective subject in the collegiate body, inferred from project allocations and the inseparable relationship between traditional peoples and nature. Conversely, the state members played a role focused either on funding bureaucracy (secondary public interest) or, at best, the primary general public interest, using the PDRS-X merely as a potential resource enhancer without necessary ties to the defense of forest-peoples. Therefore, the PDRS-X constitutes a significant episode of institutional experimentation that could legitimize the direct involvement of forest-peoples in positions of power as a means to confront deconstructive practices of rights in the Brazilian Amazon. This prior reconstructive practice corroborates that forest-peoples are protagonists in determining the flow of the Xingu River in the Reduced Flow Section, ensuring that the distribution of waters is conducted based on ecosystemic criteria that value traditional knowledge.

Este estudo é a continuação do projeto de pesquisa “Experiências de educação em direitos humanos e de mediação de conflitos no contexto escolar do Distrito Federal”, desenvolvida entre 2018 e 2022, sob coordenação da Profª Drª Nair Heloísa Bicalho de Sousa, coordenadora Núcleo de Estudos Para a Paz e Direitos Humanos do Centro de Estudos Avançados Multidisciplinares (NEP/CEAM/UnB), contemplada em fomento junto a Fundação de Apoio à Pesquisa do Distrito Federal (FAPDF). A presente dissertação tem como objetivos identificar a prática pedagógica em educação em direitos humanos dos/as professores/as do ensino fundamental – anos iniciais, bem como perceber a concepção de educação em direitos humanos que orienta as práticas pedagógicas. Para tanto, buscamos perceber se os/as professores/as possuem conhecimento acerca do Plano Nacional de Educação em Direitos Humanos (PNEDH, 2006) e das Diretrizes Nacionais de Educação em Direitos Humanos (DNEDH, 2012), principais políticas públicas relacionadas à educação em direitos humanos. Essa pesquisa é um estudo de caso exploratório, descritivo e explicativo, de abordagem qualitativa (documental) e quantitativa (estatística). Destacam-se como fundamentos teóricos: Brasil (2006, 2012); Candau (2003, 2005, 2009); Benevides (2008); Candau & Sacavino (2010); Carbonari (2006, 2007); Freire, (1987,, 1996,1999); Magendzo (2008); Sousa (2016, 2017); Zenaide (2008, 2020); Monteiro Silva & Tavares (2013); Gil (1999); Lakatos & Marconi (2003); Flick (2006); Triviños (1987); e Minayo, (2007). Como campo empírico selecionamos uma escola da rede pública de Brasília, Distrito Federal, localizada em Ceilândia. Os sujeitos da pesquisa foram doze professores/as que atuam na segunta etapa da educação básica ensino fundamental – anos iniciais, dos quais dois, desenvolvem funções direção e vice-direção. Os procedimentos metodológicos utilizados foram: entrevista semi-estruturada, à observação participante e análise documental. Para apreensão das informações obtidas nos embasamos na análise de conteúdo proposta por Guerra (2006). A pesquisa evidenciou que as categorias prática pedagógica, educação em direitos humanos e ensino fundamental – anos inciais, sinalizam identidade com a educação popular e as temáticas que são trabalhadas em sala de aula, pois a escola desenvolve projetos que tratam sobre a educação em direitos humanos e a prática pedagógica. Alguns sujeitos da pesquisa possuem concepções sobre a educação em direitos humanos que mantém aproximações com as perspectivas dos/as autores/as estudados e favorecem estudos capazes de ressignificar a relação entre a prática pedagógica e a educação em direitos humanos. Na organização prática educativa foram identificados recursos didáticos pedagógicos e metodologias participativas coerentes com a educação em direitos humanos que favorecem o empoderamento dos estudantes nas dimensões pessoal e coletiva, o que contribue para caracterização da escola como espaço concreto de vivências e promoção de direitos.

This study is the continuation of the research project “Experiences in human rights education and conflict mediation in the school context of the Federal District”, developed between 2018 and 2022, under the coordination of Prof. Dr. Nair Heloísa Bicalho de Sousa, coordinator of the Studies Center For Peace and Human Rights at the Center for Advanced Multidisciplinary Studies (NEP/CEAM/UnB), supported by the Federal District Research Support Foundation (FAPDF). The present dissertation aims to identify the pedagogical practice in human rights education of elementary school teachers – initial years, as well as to understand the conception of human rights education that guides pedagogical practices. To this end, we sought to understand whether teachers have knowledge about the National Plan for Education in Human Rights (PNEDH, 2006) and the National Guidelines for Education in Human Rights (DNEDH, 2012), the main public policies related to education in human rights. human rights. This research is an exploratory, descriptive and explanatory case study, with a qualitative (documentary) and quantitative (statistical) approach. The following stand out as theoretical foundations: Brazil (2006, 2012); Candau (2003, 2005, 2009); Benevides (2008); Candau & Sacavino (2010); Carbonari (2006, 2007); Freire, (1987, 1996,1999); Magendzo (2008); Sousa (2016, 2017); Zenaide (2008, 2020); Monteiro Silva & Tavares (2013); Gil (1999); Lakatos & Marconi (2003); Flick (2006); Triviños (1987); and Minayo, (2007). As an empirical field, we selected a public school in Brasília, Federal District, located in Ceilândia. The subjects of the research were twelve teachers who work in the second stage of basic education – primary education – initial years, of which two carry out management and deputy management roles. The methodological procedures used were: semi-structured interview, participant observation and document analysis. To capture the information obtained, we based ourselves on the content analysis proposed by Guerra (2006). The research showed that the categories pedagogical practice, human rights education and elementary education – initial years, signal identity with popular education and the themes that are worked on in the classroom, as the school develops projects that deal with human rights education. and pedagogical practice. Some research subjects have conceptions about human rights education that maintain similarities with the perspectives of the authors studied and favor studies capable of giving new meaning to the relationship between pedagogical practice and human rights education. In the practical educational organization, teaching resources and participatory methodologies coherent with human rights education were identified, which favor the empowerment of students in the personal and collective dimensions, which contributes to the characterization of the school as a concrete space for experiences and promotion of rights.

Esta pesquisa parte da condenação brasileira no caso Favela Nova Brasília versus Brasil na Corte Interamericana de Direitos Humanos (Corte IDH) e tem como objeto analisar as mortes de jovens negros no Brasil em função de intervenções policiais e seus desdobramentos na esfera judicial. A Corte IDH condenou o país em 2017 e na sentença determinou a substituição, nos procedimentos policiais, do termo auto de resistência por homicídio ou lesão corporal decorrente de intervenção policial. O objetivo central é compreender a importância da condenação e se ela está contribuindo para a redução da letalidade policial. Para isso, o trabalho foi estruturado da seguinte forma: O Capítulo 1 trata da violência policial contra a juventude negra, percorrendo o caminho histórico da prática policial brasileira e analisando o auto de resistência, a Biopolítica de Foucault e a Necropolítica de Achile Mbembe como forma de compreensão da dinâmica dessa violência. No Capítulo 2, é demonstrado o funcionamento do sistema de proteção interamericano dos Direitos Humanos e o papel da Corte IDH e da Comissão Interamericana de Direitos Humanos (CIDH) nesse processo. Já no Capítulo 3, foi feito um estudo comparado entre o caso Favela Nova Brasília e o caso Maria da Penha. A proposta deste capítulo foi compreender porque o Estado brasileiro implementou respostas diferentes para estas duas violações de direitos humanos. O Capítulo 4 traz uma entrevista com um dos maiores especialistas da Corte IDH no Brasil, o Promotor Suxberger. Ele já atuou, como perito (em duas ocasiões) na Corte IDH e no controle externo da atividade policial no Distrito Federal. Ele trouxe algumas compreensões dos motivos pelos quais o Brasil tem dificuldade em aplicar as decisões da Corte IDH. Por fim, no Capítulo 5, com base num trabalho recente do CNJ e PUCPR (2023) foi analisado os motivos dos juízes brasileiros em não aplicar nas suas sentenças as decisões da Corte IDH, perpetuando a conivência do judiciário pátrio com a violência policial. Ao final, verifica-se que a violência policial é histórica e estrutural, mas que a sociedade brasileira tem sensibilidade maior, para alguns tipos de violência (caso Maria da Penha, e menor, para outros tipos de violência (caso Favela Nova Brasília). Os juízes brasileiros estão a par deste processo, pois se recusam a utilizar as decisões da Corte IDH como forma de frear a letalidade policial brasileira.

This research is based on the Brazilian conviction in the case of Favela Nova Brasília versus Brazil at the Inter-American Court of Human Rights (I/A Court H.R.). It aims to analyze the deaths of young black people in Brazil due to police interventions and their consequences in the judicial branch. The Inter-American Court condemned the country in 2017 and, in the sentence, determined the replacement, in police procedures, of the term “self-defense acts” (in Portuguese: auto de resistência) for homicide or bodily injury resulting from police intervention. The main research goal is to understand the importance of conviction and whether it contributes to reducing police lethality. To accomplish this goal, this thesis was structured as follows: Chapter 1 examines police violence against black youth, covering the historical path of Brazilian police practice and analyzing the self of resistance, Foucault's Biopolitics and Achile Mbembe's Necropolitics as a form of understanding the dynamics of this violence. Chapter 2 shows the functioning of the Inter-American Human Rights protection system and the role of the Inter-American Court and the Inter-American Commission on Human Rights (I/A Court H.R.) in this process. In Chapter 3, we present a comparative case study that analyzes the Favela Nova Brasília and Maria da Penha cases. This chapter aimed to understand why the Brazilian State implemented different responses to these two human rights violations. Chapter 4 presents an interview with one of the greatest experts at the I/A Court H.R. in Brazil, Prosecutor Suxberger. He has already worked as an expert (on two lawsuits) at this Court and in external control of police activity in the Federal District. He explained Brazil's challenges in implementing the Inter-American Court of Human Rights decisions. Finally, in Chapter 5, based on a recent publication by the CNJ and PUCPR (2023), the role of Brazilian judges in the failure to apply the decisions of the Inter-American Court in their sentences was analyzed, perpetuating the complicity of the national judiciary with police violence. Finally, we conclude that police violence is historical and structural. However, there is evidence that Brazilian society is more sensitive to some types of violence, such as the Maria da Penha case, and less sensitive to others, like the Favela Nova Brasília case. Brazilian judges are aware of and are part of this process since they refuse to consider the Inter-American Court of Human Rights decisions in their sentences as a way of curbing Brazilian police lethality.

O tema desta dissertação é a população rueira de Brasília e sua relação com as violações de direitos humanos. Tem por objetivo geral descrever e analisar as interpretações da população em situação de rua sobre as violações de direitos humanos que têm experimentado em sua vivência rueira, em especial as que se configuram como violências e analisar se a educação formal consegue mobilizar esse grupo para a participação social pela luta por direitos e políticas públicas. Como objetivos específicos, propõe-se a discutir conceitos relevantes para essa pesquisa como população em situação de rua, violência, direitos humanos, participação social e educação não formal ;e, aproximar-me da população rueira, por meio de diferentes técnicas e estratégias, para ouvi-la como sujeito desta pesquisa, e não objeto dela. As justificativas deste estudo são a Declaração dos Direitos Humanos e todos os tratados e normas e leis e utopias de um mundo justo; o olhar apreensivo pelos rueiros e rueiras e a impotência de não conseguir fazer muito e a esperança de contribuir para que suas narrativas, suas visões de mundo, suas alegrias e dores fossem consideradas. Trata-se de uma pesquisa teórica, quali-quantitativa e de natureza simultaneamente descritiva e explicativa, com o método de estudo etnográfico associado à pesquisa-ação e à observação participante. Os principais resultados são: o reconhecimento da importância da educação em espaços não formais que trabalhem, de forma colaborativa e sensível, com a população de rua, aprendendo e ensinando sobre direitos humanos.

The theme of this dissertation is the street population of Brasília and its relationship with human rights violations. Its general objective is to describe and analyze the interpretations of the homeless population regarding the human rights violations they have experienced in their street life, especially those that constitute violence, and to analyze whether formal education can mobilize this group to participate. social struggle for rights and public policies. As specific objectives, it is proposed to discuss concepts relevant to this research such as the homeless population, violence, human rights, social participation and non-formal education; and, to get closer to the homeless population, through different techniques and strategies, to listen to her as the subject of this research, and not its object. The justifications for this study are the Declaration of Human Rights and all treaties and norms and laws and utopias of a just world; the apprehensive look at the streets and streets and the impotence of not being able to do much and the hope of contributing so that their narratives, their world views, their joys and pains were considered. This is theoretical, qualitative-quantitative research of a simultaneously descriptive and explanatory nature, with the ethnographic study method associated with action research and participant observation. The main results are: recognition of the importance of education in non-formal spaces that work, in a collaborative and sensitive way, with the homeless population, learning and teaching about human rights.

A presente Tese irá narrar a caminho de Benedita da Silva enquanto mulher negra e da favela e seu papel protagonista na luta por Direitos Humanos no Brasil. A partir da abordagem qualitativa, com aproximação biográfica narrativa interpretativa, lastreada em levantamento documental, falo de uma “mulher do fim do mundo” que navega nos mares de uma democracia hegemonicamente branca e masculina, assumindo o amor e a fé como motores de sua ação na luta pelo justo. O texto se filia teoricamente ao feminismo negro como escola do pensamento e mobiliza majoritariamente esses diálogos na construção de seu marco teórico. O desenho de estudo visa contribuir no debate acadêmico de visibilização do legado das mulheres negras brasileiras como decisivas na busca por dignidade, a partir dessa vivência única e coletiva que exprime-se em Benedita da Silva, a Bené. A tese é dividida em quatro períodos distintos da sua vida política, cada um relacionado a momentos cruciais da história do Brasil. Cada período é analisado, apontando as relações entre racismo, patriarcado e classe na construção da identidade dessa protagonista e de sua prática militante. Além disso, a pesquisa investiga as estratégias adotadas por Benedita em sua atuação política para promover os direitos humanos e os desafios enfrentados por mulheres negras na política brasileira. O texto analisa sua produção legislativa em Direitos Humanos, assim como seus pronunciamentos na temática. Compreendi no processo de investigação que não podemos enxergá-la apenas como uma Constituinte que fez história há 35 anos atrás. Que o ensinamento que dá é profundo: não desistir de defender as coisas mais belas. Ela segue rompendo paradigmas, segue transformando profundamente a construção política nacional. Bené puxa o horizonte dos Direitos Humanos mais perto dos seus, do povo trabalhador brasileiro. Ela não é passado. É presente, é futuro ancestral, como ensina Ailton Krenak.

This thesis recounts the journey of Benedita da Silva as a black woman from the favela and her leading role in the fight for human rights in Brazil. Employing a qualitative approach, with an interpretative narrative biographical framework grounded in documentary research, it delves into the story of a "woman from the end of the world" navigating the seas of a predominantly white and male hegemonic democracy. She embraces love and faith as driving forces behind her pursuit of justice. The text is theoretically aligned with black feminism as a school of thought and predominantly engages in these dialogues in constructing its theoretical framework. The study design aims to contribute to the academic discourse on the visibility of the legacy of Brazilian black women as pivotal figures in the pursuit of dignity, drawing on Benedita da Silva's unique and collective experience. The thesis is divided into four distinct periods of her political life, each linked to crucial moments in Brazil's history. Each period is analyzed, highlighting the interplay between racism, patriarchy, and class in shaping the identity of this protagonist and her activist practice. Furthermore, the research investigates the strategies adopted by Benedita in her political engagement to promote human rights, as well as the challenges faced by black women in Brazilian politics. The text analyzes her legislative contributions to human rights, as well as her public statements on the subject. Through the investigative process, it becomes clear that she cannot be solely seen as a Constituent who made history 35 years ago. The profound lesson she imparts is not to give up on defending the most beautiful things. She continues to break paradigms, profoundly transforming the national political landscape. Bené brings the horizon of human rights closer to her, to the Brazilian working people. She is not the past. Bené is the present, the ancestral future, as taught by Ailton Krenak.

A partir das metodologias Escrevivência e Escrita Afetiva, conto a vida de Mãe Dora de Oyá. Mulher negra, Ialorixá, cantora e compositora de sambas, integrante da Irmandade da Boa Morte, ex-integrante do Partido Comunista Brasileiro e fisioterapeuta, Doralina Fernandes Barreto Regis, ao se tornar Mãe Dora de Oyá, consolidou-se como referência sociopolítico-cultural não apenas para o local onde vive (Distrito Federal), mas para diversos terreiros, rodas de samba e confrarias pelo Brasil. A historiografia da cultura brasileira, seja na academia ou fora dela, é marcada pelo apagamento das mulheres negras. Dessa maneira, a presente tese é uma tentativa inicial de retomar a importância dessas mulheres a partir da história de Mãe Dora e estimular estudos que interseccionem as questões de gênero, raça, religião e cultura afro-brasileira. Por fim, mostro como as mulheres de axé, o Candomblé e o samba são elementos indissociáveis e, por isso, é possível (e preciso) pensar a dimensão espiritual do Samba. Mais do que um gênero musical, Samba pode ser entendido como um Orixá, que rege a noção de pertencimento de cada pessoa e possibilita ações comunitárias importantes para (sobre)vivência.

This study narrates the life of Mother Dora de Oyá based on the methodologies of “Escrevivência” (Writting based on lived experiences), and “Escrita Afetiva” (Emotional Writting).She is a black woman, Ialorixá (Chief of a Candomblé temple), singer and composer of samba music. Also, she is a member of the Irmandade da Boa Morte (Boa Morte’s Brotherhood), former member of the Brazilian Communist Party, and a physiotherapist. Doralina Fernandes Barreto Regis, upon becoming Mother Dora de Oyá, emerged as a socio-political reference not only for her local community (based on the Federal District) but also for various Candomblé temples, samba circles, and societies across Brazil. Brazilian cultural historiography, both within and outside academia, is caratherized by the erasure of black women. Thus, this thesis represents an initial attempt to restore the significance of these women through the story of Mother Dora de Oyá and to encourage studies that intersect gender, race, religion, and Afro-Brazilian culture. Finally, the study demonstrates how women of Candomblé tradition, the Candomblé itself and samba are inseparable elements, and, because of that, it is possible (and necessary) to consider the spitirual dimension of samba. More than a musical genre, samba can be understood as an Orixá, governing each person’s sense of belonging and enabling essential community actions for survival.

Essa tese investiga como se constituiu e como se operam os regimes de verdade aplicáveis aos corpos negros independentemente das diversas posições que eles ocupam nas práticas judiciais de veridição, partindo de duas constatações: o corpo negro como uma exceção ao regime de aplicação concreta dos Direitos Humanos, de sua desumanização, e o reconhecimento no cotidiano de que o corpo negro recebe um tratamento diferenciado quando está diante da porta da Justiça, o que se assemelha ao tratamento recebido durante a escravidão pela maioria negra. Aprofunda-se esse debate observando as lógicas de produção das provas, ou os regimes de verdade, tema presente em diversos ramos do Direito, mas especialmente no pensamento foucaultiano. A hipótese central dessa investigação é de que os regimes racializados de produção da verdade sobre os corpos negros reatualizam a colonialidade do direito e dos sistemas de justiça. Nos capítulos iniciais serão apresentadas as categorias conceituais fundamentais para o desenrolar da pesquisa. Para tanto, serão articuladas as principais categorias foucaultianas, quais sejam: a relação poder-saber, o discurso, subjetividade, dispositivo e regimes de verdade/jogos de verdade. Tais noções serão revisadas sob a perspectiva dos estudos raciais, com destaque para Sueli Carneiro, a qual inscreveu a problemática racial no campo analítico dos conceitos de dispositivo e do biopoder, apresentando o “dispositivo de racialidade”. Essa perspectiva crítico-racial prossegue no terceiro capítulo, que situa a branquidade do poder no contexto dos regimes de verdade judicial. No quarto capítulo o regime de verdade judicial é pensado a partir de uma crítica à tradição dogmático-formalista, traçando-se as especificidades da prática discursiva dos juristas, os marcos referenciais da produção da verdade judicial e as condições de possibilidades do dizer verdadeiro no campo jurídico. A partir das noções gerais e da compreensão do papel da dogmática na racialização dos regimes de verdade, o capítulo cinco apresenta a emergência da legislação simbólica antiescravista, as características do Poder Judicial no período oitocentista e o funcionamento da justiça de conveniência no julgamento dos corpos negros, abordando os dilemas em torno da prova da posse da liberdade vivenciados pelo "negro-autor" de ações cíveis de liberdade e de escravidão, pelo “negro-vítima" nas ações de crimes de redução de pessoa livre à escravidão, e pelo “negro-réu” nas ações penais de crime praticados pelos escravos, que caracterizou um “Direito Penal de Exceção”. Por fim, o último capítulo aborda como, apesar de todo refinamento teórico dos juristas dogmáticos acerca da verdade judicial, da produção da prova e dos marcos referenciais que garantiriam um processo “justo”, as práticas judiciais reatualizam a colonialidade do direito e dos sistemas de Justiça. Para entender os traços dessa racialidade, o “negro-réu” será analisado sob a ótica da seletividade racial. A parte final desse capítulo se dedica à apresentação dos resultados da pesquisa exploratória e ao estudo de casos das práticas judiciais do Distrito Federal que têm em comum o julgamento de corpos negros. Para tanto, investiga-se as ações de crime de racismo e injúria racial em que o “negro-vítima”, representado pelo Ministério Público, busca a responsabilização penal do ofensor e a indenização pelos danos morais e, numa análise transversal, apresenta-se as dinâmicas das ações cíveis e trabalhistas autônomas de reparação de danos morais ajuizadas pelas próprias vítimas.

This thesis investigates how truth regimes are constituted and operate on Black bodies, regardless of their diverse positions within judicial veridiction practices. It begins with two observations: the Black body as an exception to the concrete application of Human Rights, leading to its dehumanization, and the recognition that Black bodies receive differential treatment when facing the doors of courts of justice, reminiscent of the treatment experienced by the Black majority during slavery. This debate is further deepened by examining the logics of evidence production or truth regimes, a topic present in various branches of the law, particularly in Foucauldian thought. The central hypothesis of this research is that racialized truth regimes about Black bodies reactualize the coloniality of law and justice systems. The initial chapters will introduce the fundamental conceptual categories for the progression of the research. To do so, the primary Foucauldian categories will be articulated, namely: the power-knowledge relationship, discourse, subjectivity, “dispositif” and truth regimes/truth games. These concepts will be revisited from the perspective of racial studies, with emphasis on Sueli Carneiro, who incorporated racial issues into the analytical field of the concepts of “dispositif” and biopower, presenting the "raciality dispositif." This critical-racial perspective continues in the third chapter, which situates the whiteness of power within the context of judicial truth regimes. In the fourth chapter, the judicial truth regime is examined critically in contrast to the dogmatic-formalistic tradition. Then, the specificities of the discursive practice of jurists will be presented, such as the referential frameworks for the production of judicial truth and the conditions of possibilities for true saying in the legal field. Building on the general notions and the understanding of the role of dogmatics in the racialization of truth regimes, the fifth chapter discusses the emergence of anti-slavery symbolic legislation, the characteristics of the Judiciary in the nineteenth century, and the operation of convenience justice in the judgment of Black bodies. It addresses the dilemmas surrounding proof of freedom in lawsuit brought by the "Black plaintiff" in civil actions for freedom and slavery and the "Black victim" in actions for crimes reducing a free person to slavery. It also explores the "Black defendant" in criminal actions committed by enslaved individuals, characterized as "Exceptional Criminal Law." Finally, the last chapter delves into how, despite the theoretical refinement of dogmatic jurists regarding judicial truth, evidence production, and reference points that would ensure a "fair" trial, judicial practices reactualize the coloniality of law and justice systems. To understand the features of this raciality, the "Black defendant" will be analyzed from the perspective of racial selectivity. The final part of this chapter is dedicated to presenting the results of exploratory research and case studies of judicial practices in the Federal District about judgment of Black bodies.
